Spend a quiet evening in front of the fire playing board games or watching a movie on the flat screen TV. Take advantage of the warm summer evenings by grilling out on the back patio. Upstairs there are 3 bedrooms, 2 bathrooms and laundry room with washer and dryer. The master bedroom has vaulted ceilings, king size bed, views of the valley and bathroom with marble counter-tops. The second bedroom has views of the slopes and a queen size bed. The third bedroom has double sized bunk beds and lots of children`s toys/books. To get to the slopes you can pull the car out of the heated garage and drop the skiers off in just 2 minutes. The city bus picks up at the entrance to the town-homes which is a 2 minute walk. Or you can walk to the base of the mountain in about 10 minutes. The seasonal heated swimming pool is very well maintained, quiet and open from the end of May to the end of October. The two hot tubs are open year round from 6 a.m. to 10 p.m.

IMPORTANT - HOA RULES AND REGULATIONS:
Approved August 24, 2017. MORAINE TOWNHOME ASSOCIATION RULES AND REGULATIONS The MORAINE TOWNHOME ASSOCIATION, a Colorado non-profit corporation (the “Association”), by virtue of the authority provided in the Townhome Declaration (the “Declaration”) for the Moraine Townhomes, and in the Article of Incorporation and Bylaws of the Association, does hereby publish and declare the following Rules and Regulations respecting all of the properties now and hereafter subjected to the Declaration and all units, common elements and improvements thereon (the “Townhome Project”), all property of the Association for common use, and the use and occupancy by owners, tenants, guests and invitees of the Units and the common elements. 1) Purpose. These rules and regulations are made for the purpose of promoting the best interests of the owners and occupants of units in the Townhome Project, to secure full, fair and safe utilization and enjoyment of the Townhome Project by such owners and occupants, to protect and enhance the property values of the units, to protect persons and property against injury or damage, and in general to promote the health, safety, moral and general welfare of the owners and occupants and to make the Townhome Project a pleasant place in which to live. 2) Applicability. These rules and regulations are applicable to owners, tenants, guests and invitees of owners, and shall be deemed in addition to, and not in lieu of, all applicable provisions of the Declaration/Articles of Incorporation, Bylaws and Responsible Governance Policies which shall control in the event of any inconsistency with these provisions. Each owner is responsible and liable for the acts or omissions of such owner’s tenants, guests and invitees respecting compliance with these rules and regulations and the Declaration. The Association or its manager or managing agent will make reasonable efforts to warn owners, tenants and guests of infractions of these rules and regulations, but failure to so warn shall not be an excuse for or defense of such infraction. 3) Tenants and Guests. An owner who rents his unit to a tenant or guest must advise the Association and its manager or managing agent in writing. When renting their unit, all owners must have a rental agreement with the renters with these Rules and Regulations attached. When signing the rental agreement, the renter acknowledges receipt of the Rules and Regulations. All owners who rent must provide a 24 hour contact person and telephone number to handle any problems with tenants. Additionally, any owner who rents his unit is obligated to post a list of Rules and Regulations and a condensed version prepared by and approved by the Association in a prominent place within the unit. Owners are responsible for the conduct of their renters, 2 visitors, guests and contractors. Owners are not allowed to rent to sports teams, companies, corporations, or any other business entity. Occupancy limits have been established based on the number of bedrooms in the townhome unit. A total of two (2) people are allowed per bedroom plus two (2) additional peoples. Occupancy limits for a one bedroom townhome is four (4), six (6) for a two bedroom unit, eight (8) for a three bedroom unit, ten (10) for a four bedroom unit, and twelve (12) for a five bedroom unit. 4) General Rules and Regulations. a. Patio furniture, flower containers, holiday wreaths and decorations are allowed to be placed on front entrance stoops, patios, and balconies, even if these areas encroach on the common area or limited common area. Except for loading and unloading, no boats, campers, large trucks, trailers or other personal property, of whatever size, shall be stored on or allowed to remain on the common elements such as the grounds, driveways or parking lots, unless in an area previously set aside for such purposes by the Association. One state or American flag may be hung in the front of unit. Planting of new shrubs or trees must be preapproved in writing by the Landscape Committee. b. Owners and renters are expected to keep the area around their units neat and clean, including decks, patios, rear areas and front entrances. Nothing may be stored on or hung from balconies or decks that extend above or below the balcony or deck floor. If an owner is remodeling a unit, the owner is responsible for renting a separate dumpster for remodeling trash. All remodeling trash must be hauled to the dumpster as it accumulates on a daily basis. c. No owner or occupant shall make or permit any disturbing noises to be made in any unit by himself, his family, guests, tenants, or other invitees, nor do or permit anything to be done by such persons that would interfere with the rights, comforts, or convenience of neighboring owners or occupants. Noise and other “disturbing the peace” issues are to be reported to the Steamboat Springs Police Department at 970-879-1144. Acts of vandalism are also to be reported to the Police Department and the Property Manager at Central Park Management at 970-879-3294. Fines will be assessed against owners in accordance with Section 7 on fines in this document. No fireworks are permitted on the townhome association premises. d. Owners and occupants shall not be allowed to place any identifying sign on the exterior of any unit or in the window of any unit, except for a small name or identification sign on the door of the unit owned or occupied by such owner or occupant. Owners and occupants shall not paint, stain or varnish any part of the exterior of any unit, since that responsibility lies with the Association. e. Children shall not be permitted to loiter or play unattended on the parking areas or the pool/hot tub area. Children shall be permitted to play on the common grassy areas during the daylight hours only. 3 f. Other than the Owner of a townhome, no guests, tenants or other occupiers of the townhome shall harbor any dogs, cats or other animals upon or within a townhome, a patio or balcony appurtenant to a townhome, the common open space or the Limited Common Open Space. The City of Steamboat Springs will prosecute incidents of dogs being off-leash in homeowner association common areas as these areas are deemed public areas by the City. The Moraine Townhome Association has adopted the City’s position for safety reasons and to avoid potential legal problems and insurance claims. An owner of a unit, while such owner is occupying the same, may keep and maintain cats and dogs (not exceeding two such animals) provided that (i) dogs are kept on a leash at all times, and owners must be with them at all times outside of their unit, (ii) such pets do not infringe upon the use and enjoyment by occupants of other adjacent units, and (iii) such owner promptly cleans up and disposes of all dog feces in proper receptacles. There are two pet waste facilities in the common area. If an owner fails to clean up and dispose of dog feces, the first offense will result in a fine (see Section 7 Fine Schedule). No warning will be given. Dogs outside of the owner’s premises must be on a leash at all times. Dogs and cats are not permitted to run at large. If an owner violates this provision, a warning will be given and subsequent violations will result in fines. If guests of owners arrive with pets, owners are responsible to inform them of these pet rules. If an owner, or a tenant of an owner, violates this provision, the owner shall be liable to the Association for fines. g. Trash and refuse shall not be stored or kept on any common elements or outside of any unit. Each owner, tenant, and guest is responsible for placing garbage in tied plastic bags into the trash collection dumpster, and not on the floor or in the recycle bins. After dumping trash in dumpsters, replace the bear bar on top of the dumpster and lock. Lock the latches on the recycle bins. h. Barbeque grills are limited to gas grills only. No charcoal grills are allowed. Grills may be stored at the back of units. Grills may not be stored anywhere in the front of units, on common areas, or on any common element. Absolutely no grilling in garages. i. Water shall not be left running for any unreasonable or unnecessary length of time in any of the units or in any of the common elements. j. No owner or occupant shall interfere in any manner with any portion of the central utility lines or appurtenances running underneath a unit or through any wall or roof structure or the fireplace flues. No owner or occupant may tamper with the irrigation and sprinkler systems. k. No signs, posters or advertisements of any kind shall be placed in the interior or exterior or windows or upon doors or upon other exterior surfaces or common elements without the prior approval of the Board of Directors. No changes will be made to the exterior of the townhomes without the written request from the owner and approval from the Board of Directors. Exterior improvements or changes are allowed with the approval of the Board of Directors. No antennae, aerial, outside 4 wiring, exterior vented air conditioning, or similar connection or installation shall be installed by owners or occupants outside or on the roof of a unit. Any such antennae, aerial or wiring erected on the roof of exterior walls of any unit without the prior written consent of the Association may be removed without notice at the owner’s expense if the removal is in compliance with FCC regulations. l. The Directors of the Association, or managing agent, may retain a passkey to each unit. No owner or occupant shall alter any lock or install a new lock on any door leading into the unit of such owner without the prior consent of the Association. If such consent is given, the owner or occupant shall provide the Association with a key for use by it or by its managing agent. If any owner does not wish to provide the Directors of the Association, or its managing agent, a key, the owner must sign a release stating the Directors of the Association, or its managing agent have the right to break into the unit in the case of an emergency, i.e. fire, water pipe breakage etc. The Association management company must give 24 hour written notice to access townhome units under non-emergency situations. m. All Owners and Members must submit a written request for permission and receive written approval from the Board of Directors to add any new trees, plants, bushes and flowers in the common area or limited common area of the Association. Any and all trees, plants, bushes and flowers added by owners are their responsibility to maintain and replace. If any said new plants die, it is the responsibility of the unit Owner who planted them to remove them. It is the responsibility of the owner or Member to inform a Buyer of all plants that become the responsibility of that Buyer at the closing of the property. 5. Parking Area Regulations a. Park vehicles only in designated areas. No vehicle belonging to an owner or to a member of his family or to his tenants, guests or invitees shall be parked in such a manner as to impede or prevent ready access to other parking spaces by other persons or to impede access to the dumpster enclosures. Abandoned vehicles will be removed by the Association. No vehicle will be left standing in a parking area in a non-operative condition, nor shall there be any repairs, maintenance, lubrication or washing of vehicles done on the areas designated for parking. Owners and long term tenants are allowed to wash their personal vehicles in the driveway area allotted for their unit. Owners are allowed to use the “Visitor’s Parking” but vehicles cannot be left unmoved for a period exceeding 7 days. b. An owner shall not park a vehicle nor shall he permit his family, guest, tenants or invitees to use parking spaces or driveways of other owners without permission. The Association reserves the right to remove vehicles improperly parked or left in another owner’s space, at the expense of the vehicle’s owner. c. Vehicles must be moved from a snowplow’s path as soon as possible so driveways and parking areas can be cleared without vehicle interference. If necessary, 5 vehicles that are not moved regularly and interfere with snow removal will be towed at the owner’s expense. d. The primary parking areas for owner, tenant and guest parking are in the garage of a unit and on the driveway. In addition one vehicle per townhome unit may park in the paved off-street parking areas of the development not designated a fire zone. No vehicles can be parked in fire lanes or where they impede traffic or block driveway access. Vehicles illegally parked will be subject to towing at the owner’s expense. 6. Pool Area a. Pool and hot tub rules are posted on the pool gate, inside the pool area and on the wall of the building. All owners and short term and long term tenants must read all the posted rules prior to use of facilities. b. No one except property management or Board authorized personnel is allowed to enter the pool area when the gate is closed for the night at 10 PM and prior to opening at 9 AM each day. c. No pets are permitted in the pool area. d. No food is allowed in the pool area, except at the tables. e. Babies and toddlers under the age of 3 years or any toddlers not potty trained must wear swim diapers while in the pool or hot tubs. Children under the age of 14 years must be accompanied by an adult. Children under the age of 14 years are prohibited in the pool area after 8:00 p.m. f. The pool area is limited to the use by owners, long term and short term tenants and owner’s guests when the owner is present. It is prohibited for short term tenants to bring guests to the pool area. g. No barbeque grills or cooking of any kind is allowed in the pool area. No glass items are allowed in the pool area. h. Boisterous and unruly behavior is not allowed. Noncompliance will result in fines to the owner of the unit where the persons are staying or visiting. i. Article XIV of the Declaration of Covenants, Conditions and Restrictions and Section 1 of the Responsible Governance Policies prohibit owners, renters and guests of an owner who is delinquent in his or her monthly assessments from using the recreational facilities in the development. 6 7. Fine Schedule The following is a list of the four categories, subsequent violations in any categories are subject to the fines listed under “Second Violation” and “Third and Subsequent Violation” for that category. Note 2: Exception to Section 4 fine schedule: No warning will be given to an owner who does not clean up and dispose of all dog feces. The first violation will result in a fine of $50, $100 for the second offense, and $150 for the third and subsequent offenses. All violations will be reported to the 24 hour contact person required per section 3) Tenants and Guests for rental units and to the owner for all other units. A second violation shall be any new incident under any of the four categories listed above that has not been cured in the “Time period to Cure” column of the Fine Schedule. A third or subsequent violation shall occur after the “Time Period to Cure” after the second violation. All violations must be reported to the property management company, Central Park Management at (970) 879-3294 for enforcement. 7 Fines shall be due and payable within 15 days of notice and thereafter shall bear interest at the rate of 18% per annum. Unpaid fines shall be added to and become a part of the member’s assessment and shall be subject to the collection procedures set forth in Policy 1 of the Responsible Governance Policies, Collection of Unpaid Assessments. Owners are responsible for the payment of fines regardless of who occupies the owner’s unit. Owners shall secure a proper security deposit from renters to insure reimbursement from the tenant for any fines levied and other expenses from the rental. The final Rules and Regulations will be mailed to all existing owners and any new owners in the future with a return acknowledgement signature from each owner acknowledging receipt of the Rules and Regulations.
